NextCar Rental Terms and Conditions
  1. Local Terms and Conditions:

    The rental company operating the local NextCar vehicle rental office may have additional requirements and policies. When the local rental office’s requirements and policies differ from those listed here, the local rental office’s requirements and policies will apply. For more information about local rental policies, terms, and conditions, check the local rental location’s web page.

  2. Vehicle Rental Requirements: What will I need to rent a vehicle?
    1. A Valid Driver’s License. (Please refer to Section 5 for additional information.)
    2. A Credit or Debit Card. (Please refer to Section 6 for additional information.)
      • The name on the card must match the name on the driver’s license.
      • The address associated with the credit/debit card must match the address on the Driver’s License.
    3. Collision Damage Coverage. (Please refer to Sections 7 and 9 for additional information.)

      What can I use to provide Collision Damage Coverage?

      • Your Personal or Business Automobile Collision Insurance, in your name, with a deductible of $1,000.00 or less, and premiums paid up to 30 days from the vehicle rental date.
      • A Credit Card with Car Rental Coverage.
      • Or, you may qualify to purchase the Collision Damage Waiver (CDW) at participating rental locations. Two (2) proof-of-residency documents (please refer to Section 3) are required to purchase this waiver. Currently, Baltimore NextCar locations offer this optional product only to drivers with Maryland driver's licenses.
    4. Primary Liability Insurance. (Please refer to Sections 8 and 9 for additional information.)

      What can I use to provide Primary Liability Insurance?

      • Your Personal or Business Automobile Liability Insurance, in your name, with a deductible of $1,000.00 or less, and premiums paid up to 30 days from the vehicle rental date.
      • Or, you may purchase the Renter’s Liability Protection Insurance at participating rental locations.
  3. Proof of Residency Documents:

    You may use any two (2) of the following proof-of-residency documents. The addresses on the two proof-of-residency documents must match the address on the driver’s license. The documents or digital files must be dated within 30 days of the rental date.

    • Bank or Payment Card Statement with the same home address as the driver’s license. (digital version accepted)
    • Mobile phone or telephone company invoice that is not past due and has the same home address as the driver’s license. (digital version accepted)
    • Utility Invoice (gas, electric, or water bill) that is not past due and has the same home address as the driver’s license. (digital version accepted)
    • Mortgage Statement or Auto or Home Insurance Invoice with the same home address as the driver’s license. (digital version accepted)
    • Government-issued ID or United States Military Identification Card, in the same name as the driver’s license and payment card.

    Debit card requirements vary by location. Please refer to the location’s terms and conditions for specific information on the acceptance and use of debit cards at the NextCar office where you intend to rent a vehicle.

  4. Prepaid Reservations: Rates, Modifications, Cancellations, Total Price, Early or Late Drop-off, and Other Restrictions:

    Prepaid rates are offered at a low price because the customer pays in advance for a non-refundable reservation. The name on the credit card must match the driver’s name. The same credit card must be presented at the counter at pick-up. An advance payment in full is required. Your credit card will be charged immediately for the entire cost of the rental reservation. The rental vehicle’s security deposit will be charged when you pick up the vehicle. Prepaid rates are subject to availability at participating locations. Charges cannot be applied to other rentals, services, or merchandise. Rental vehicle rates and availability are not guaranteed until full payment is received.

    1. Prepaid Reservation Modification/Cancellation:

      The prepaid rate you selected applies to the exact date(s), rental days, and car type reserved. No modifications to your reservation (including, but not limited to, name changes, date changes, etc.) are permitted.

      You may cancel your prepaid reservation up to 48 hours before the scheduled pick-up time. A 5% cancellation processing fee will apply. No refunds will be issued for early returns of a prepaid reservation. If you fail to pick up your rental car at the scheduled pick-up date and time, your reservation will default to a no-show status, and you will not receive any refund or credit.

      We reserve the right to cancel reservations without notice if it appears that a customer has engaged in fraudulent, illegal, or inappropriate activity or under other circumstances where it appears that the reservation contains or results from a mistake or error.

    2. Total Price:

      The price you selected includes the rental car rate, estimated taxes, and applicable fees. It does not include additional fees or charges that may be incurred during your rental. The security deposit is also not included and is due at the time of pickup.

    3. Early or Late Drop-off:

      At check-out, NextCar will verify your drop-off date. Rates quoted are based on the pick-up date and length of rental. Should you choose to drop the vehicle off before or after the drop-off date, the price is subject to change. If you return the vehicle early, you will not receive any credit or refund. Extensions are subject to availability and prevailing rates, and the prepaid rate you selected may not apply.

    4. Other Restrictions:

      The prepaid rate may not be combined with any other offers or promotions. Prepaid rate reservations may not be eligible for loyalty programs or frequent flyer miles.

  5. Driver’s License:

    United States Residents and U.S. Military Personnel:

    A renter, additional renter, or authorized additional driver who is a resident of the United States must present at the time of rental a driver’s license issued by any state, territory, or possession of the United States that is valid for the entire rental period. NextCar will accept a valid U.S. military identification card plus an expired state-issued driver’s license for active-duty U.S. military personnel in states where they can drive on an expired driver’s license. NextCar will accept a state-issued temporary driver’s license when valid for the entire rental period, or a traffic citation issued as a temporary license when valid for the entire rental period, with the court date as the expiration date (from states that observe this practice), both when accompanied with an additional form of photo identification with a signature, other than the payment card used for the rental security. NextCar will accept a driver’s license notated with “NOT ACCEPTABLE FOR OFFICIAL FEDERAL PURPOSES” or similar notation if issued by a bordering State to the State of the NextCar office where you intend to rent a vehicle. NextCar does not accept a learner’s permit or provisional license as a valid driver’s license.

    International Driver’s License:

    A renter, additional renter, or authorized additional driver who is a resident of a country outside the United States must present at the time of rental a driver’s license issued by the country of residence that is valid for the entire rental period. If the driver’s license is not in English, the renter and any additional renters or drivers will be required to present both the foreign-issued driver’s license and a current International Driver’s Permit (“IDP”) or, if from Japan, a Japanese Translation Service. An IDP does not grant a person the right to drive, but provides a certified translation of a valid foreign driver’s license. An IDP can be obtained in the driver’s country of residence only with a valid driver’s license. An IDP (or certified translation) without a foreign-issued driver’s license is not acceptable. The renter, additional renter, or authorized additional driver may also be asked to show a passport, visa, or other current U.S.-issued documentation at the beginning of the rental, authorizing each person to be present in the USA for the entire rental period.

    Driver’s License Restrictions:

    We do not accept restricted or branded driver’s licenses, except those restricted for corrective lenses, which require the driver to wear glasses or contact lenses while driving.

  6. Deposits and Payments:

    To rent a NextCar vehicle, the renter, additional renter, or authorized additional driver must present, at the time of rental, a physical payment card (credit or debit) in each individual’s own name with sufficient available funds. The name and signature on the driver’s license must match those on the payment card. The address associated with the payment card must match the address on the Driver’s License. Eligible payment cards are American Express, Discover, MasterCard, or Visa. NextCar does not accept the small “key ring” payment cards issued by these companies. All cards must have an embedded microchip and be readable when inserted into our chip-and-PIN-certified card reader. Cards with only magnetic swipes are not accepted. Prepaid Debit cards are not accepted.

    1. Credit Card User:

      At the start of the rental process, when a renter, additional renter, or authorized additional driver uses a credit card that includes rental car coverage as a card benefit to meet the rental Collision Damage Coverage requirement, NextCar will verify the card issuer’s damage coverage for the selected vehicle type. Most credit cards do not provide Primary Liability Insurance. Please refer to section 2.d. for guidance on providing primary liability insurance to meet the location’s rental requirement.

      Most credit cards require you to use the card at the beginning of the rental and to continue using it through the end of the rental, when the card is used to provide the car rental damage coverage. Most credit cards limit the number of days for which the car rental damage coverage applies.

      Most credit card damage coverage pays a claim only after the renter’s personal or business insurance has been used. Each credit card issuer has different vehicle exclusions, so you should contact the card issuer with questions about vehicle coverage.

      When the renter’s credit card does not provide rental car damage benefits because the vehicle is “excluded,” the renter’s automobile insurance verification process must be completed, or the Collision Damage Waiver may be purchased, to confirm coverage for the rented vehicle.

      At the beginning of the rental, an authorization hold will be secured on the credit card provided to cover the full rental cost, plus an additional security deposit of $250.00 at most NextCar locations or $350.00 for local customers at BWI. Refer to location-specific policies for more information as deposits vary by location. These funds will not be available for your use until after you return the vehicle and your bank releases the funds.

      Because credit card requirements vary by location, please refer to the location’s terms and conditions for specific information on credit card acceptance and use at the NextCar office where you intend to rent a vehicle.

    2. Debit Card User:

      When a renter, additional renter, or authorized additional driver presents an eligible checking account debit card at the beginning of the rental to qualify to rent, NextCar will perform an insurance verification with the customer’s personal or business auto insurance carrier to verify that the insurance policy has been prepaid for a minimum of 30 days from the date of the rental and will provide collision and liability insurance benefits to cover the rental with a deductible no greater than $1,000.

      If the customer’s auto insurance policy fails to provide collision and liability insurance benefits to meet the NextCar rental requirements, the rental contract will not be processed. The contract may proceed if the customer provides a major credit card with verifiable rental car damage coverage and chooses to purchase the Renter’s Liability Protection Insurance (RLP) or qualifies to purchase the optional NextCar Collision Damage Waiver (CDW) and chooses to purchase Renter’s Liability Protection Insurance (RLP).

      When a renter, additional renter, or authorized additional driver presents an eligible checking account debit card at the beginning of the rental, a debit will be processed on the card provided to cover the full rental cost, plus an additional security deposit of $250.00 at most NextCar locations or $350.00 for local customers at BWI. Refer to location-specific policies for more information, as deposits vary by location.

      These funds will not be available for your use until after you return the vehicle and your bank releases them. Some banks take up to 14 business days to return funds to a debit card.

      When a debit card is used to purchase NextCar’s optional Collision Damage Waiver (CDW), two (2) proof-of-residency documents must be presented at every NextCar location.

      Currently, Baltimore NextCar locations offer the Collision Damage Waiver (CDW) only to Maryland driver’s license holders. Non-Baltimore NextCar locations may offer CDW to customers with a valid driver’s license issued by a state bordering the state of the NextCar office where you intend to rent a vehicle. Always review the local rental policies, terms, and conditions for the NextCar location you plan to rent from.

      When any renter, additional renter, or authorized additional driver’s license is issued from a non-bordering state, an official return travel confirmation on a scheduled mode of public transport must be presented at the time of rental.

      At BWI Airport, for non-local renters, a return travel confirmation may be used in place of two proof-of-residency documents.

  7. Insurance Responsibility for Damages and the Rental Vehicle:

    The renter, additional renters, or authorized additional drivers are fully liable for any loss or damage to the rental vehicle, even if someone else caused it or the cause is unknown, whether due to theft, fire, hail, flood, collision, vandalism, or any other cause, subject to any limitations imposed by the law where the vehicle is rented. This liability will not exceed the full value of the vehicle, plus actual towing and storage charges; loss of use; diminution in value (regardless of whether the vehicle is repaired), a reasonable administrative fee, pro-rata license fees, all rental charges through the date you report the incident if not returnable or the contract return date, whichever is later, and any other out-of-pocket expenses incurred by NextCar as a result of the loss or damage to the vehicle.

  8. Insurance Responsibility for Damages and 3rd Party Liability:

    The renter and or any additional renter and or authorized additional driver (and the respective insurance companies of each) is primarily responsible for all third-party liability claims of personal injury, including death, and property damage caused or arising from the use and operation of the NextCar vehicle during the rental. If NextCar is required to provide primary coverage, it shall only be in an amount necessary to satisfy the minimum financial responsibility limits required by law. Where permitted, NextCar does not provide uninsured and underinsured motorist coverage. In those states where NextCar must provide such coverage, NextCar will only provide such coverage up to the minimum limits required by law.

    1. All renters must have verifiable collision and primary liability coverage for the rental. The most common way to provide verifiable collision coverage is through the car rental damage benefits offered by a credit card issuer. Most credit cards do not include liability coverage as part of the card’s benefits. Primary Liability coverage may be provided through the renter’s or driver’s personal or business auto insurance policy. To help customers meet the primary liability rental requirement, most NextCar locations offer the option to purchase Renter’s Liability Protection Insurance.
    2. Coverage from 3rd-party carriers may be acceptable if the policy has been prepaid for up to 30 days from the rental date, includes collision insurance for the rental vehicle, and has a deductible no greater than $1,000. If the 3rd-party carrier’s coverage does not provide primary liability insurance, the primary liability insurance may be provided through the renter’s or driver’s personal or business auto insurance policy. To help customers meet the primary liability rental requirement, most NextCar locations also offer Renter’s Liability Protection Insurance for purchase.
    3. When customers do not have or choose not to use the options mentioned above, they may be eligible to purchase the NextCar Collision Damage Waiver and the Renter’s Liability Protection Insurance. Product availability, coverage, and cost may vary by location. Please refer to the location’s terms and conditions for insurance and protection plans at the NextCar office where you plan to rent the vehicle.
  9. Your Auto Insurance, Collision Damage Waiver, Renter’s Liability Protection Insurance, Road Hazard Towing, Deductible Waiver, and Other Optional Coverages:

    At the beginning of the rental, you may use your personal or business auto collision and liability insurance to meet the rental requirements. If your auto insurance policy does not provide collision and liability coverage, NextCar locations offer, for an additional daily charge, the Collision Damage Waiver (CDW) and Renter’s Liability Protection Insurance (RLP) to help customers meet the rental requirements.

    Many NextCar locations also offer, for an additional daily charge, Road Hazard, Towing Deductible Waiver (RHTDW), Personal Accident Personal Effects Protection (PAE), and Supplemental Liability Insurance (SLI), which is excess or secondary liability insurance. Primary, not excess, liability insurance is required for the rental. Separate brochures are available at the rental location summarizing the optional products. The cost, coverage, provider, and availability vary by location, vehicle category, and rate.

    The optional products offered by NextCar may or may not duplicate coverage provided by the renter’s personal automobile insurance or insurance the renter may have through another source. Purchase of optional products is not required to rent the vehicle; however, all renters must provide verifiable collision and primary liability coverage for the rental.

    1. Collision Damage Waiver (CDW)

      If the renter purchases the optional Collision Damage Waiver plan, NextCar will agree to waive the renter’s responsibility for loss or damage to the vehicle. Collision Damage Waiver is not insurance or an insurance product. CDW does not apply if: (1) the renter uses the vehicle in violation of the rental agreement; or (2) the vehicle is stolen or vandalized; or (3) the renter fails to notify NextCar and the police immediately after the loss; or (4) the renter fails to pay the charges under the rental contract.

      Before deciding whether to purchase CDW, the renter may wish to determine whether their own automobile insurance or credit card agreement provides coverage for rental vehicle damage or loss, and the deductible amount under that coverage. The purchase of CDW is not mandatory; however, all renters must have verifiable collision coverage for the rental vehicle. CDW is not insurance. CDW is offered only to renters with a Maryland-issued driver’s license at the following NextCar Baltimore-area locations: 6922 Liberty Road, 6800 Belair Rd, 601 Dundalk Ave, 101 East North Avenue, and 6500 Baltimore National Pike in Catonsville. At those locations, renters with licenses issued outside of Maryland may not purchase CDW.

    2. Primary Liability Insurance: Renter’s Liability Protection (RLP)

      The purchase of Renter’s Liability Protection Insurance (RLP) is not mandatory; however, all renters must have verifiable Primary Liability Coverage for the rental. RLP is insurance. Renter’s Liability Protection (RLP) provides the renter with liability insurance at the policy limits required by the state. Many NextCar locations offer RLP at an additional daily charge. This insurance will help protect the renter should the renter injure another person in an accident or damage another person’s property while operating the rental vehicle, up to the policy limits. The coverage does not apply in Mexico. Before deciding whether to purchase RLP, the renter may wish to confirm whether their own automobile insurance provides liability coverage that meets the rental requirement and what the deductible is under that coverage. Most credit cards do not provide liability insurance as part of the card’s benefits.

    3. Road Hazard, Towing, and Deductible Waiver (‘RHTDW’)

      If the renter purchases the optional Road Hazard, Towing, and Deductible Waiver (RHTDW) plan, NextCar will agree to waive up to $1,000 of the renter’s financial responsibility for any one (1) of the following selected by the renter at the conclusion of the rental: (a) damage to glass or tires; (b) Roadside Assistance Services; or (c) your insurance deductible. RHTDW does not cover the wheels, theft, theft-related damage, or damage caused by unauthorized drivers. RHTDW is not insurance. RHTDW does not apply if: (1) the renter uses the vehicle in violation of the rental agreement; (2) the vehicle is stolen or vandalized; (3) the renter fails to notify NextCar immediately after the loss; or (4) the renter fails to pay the charges under the rental agreement. Many NextCar locations offer RHTDW.

    4. Excess Liability Insurance: Supplemental Liability Insurance (SLI):

      Supplemental Liability Insurance (SLI) is excess or secondary liability insurance, not primary liability insurance. SLI affords the renter and any authorized driver (the Renter) with liability insurance in excess of the underlying limit, which is the higher of: (1) any existing liability insurance, which may include the renter’s own insurance, or (2) the applicable state minimum financial responsibility limits, which vary by state. SLI policy limits are the difference between $300,000 and the underlying limit, per accident. This insurance will help protect the renter if the renter injures another person in an accident or damages another person’s property while operating the rental vehicle, up to the policy limits. SLI does not cover damage or injury to the driver or additional operator, family or household members, or passengers. SLI coverage may duplicate coverage already provided by insurance policies applicable to you. The rental car agency is not qualified to evaluate the adequacy of your existing insurance policies. The purchase of SLI is not required to rent a vehicle. SLI does not apply in Mexico.

      Product availability, coverage, and cost may vary by location. Please refer to the location’s terms and conditions for optional protection plans at the NextCar office where you plan to rent a vehicle.

    5. Personal Accident and Effects (PAE):

      Personal Accident/Personal Effects Protection consists of the following benefits during the term of your rental:

      • Accidental Death Benefit
      • Accidental Medical Expense Benefit
      • Ambulance Expense Benefit
      • Personal Effects Coverage

      All benefits are subject to the exclusions, terms, conditions, limitations, and coverages as expressly described in the underlying policy, which is available for inspection at the car rental office, and are conditioned upon compliance with the terms of your Rental Agreement. The purchase of Personal Accident / Personal Effects Protection is entirely optional; you are not required to purchase it to rent a car.

  10. Additional Renters and Drivers:

    The NextCar vehicle may be driven only by a renter, additional renter, or an authorized driver listed in the rental contract. All renters, additional renters, and authorized drivers must qualify to drive the NextCar vehicle. To qualify, NextCar requires that all renters, additional renters, and additional drivers (including spouses) appear at the time of rental and provide a valid driver’s license, with a physical street address (residence), an accepted payment card in their own name with funds available, sign the rental agreement, and pay an additional renter or driver fee. All renters, additional renters, or authorized drivers may be subject to a driver record check and/or a credit record check. Government renters on official orders, corporate account customers renting under corporate rate plans, and drivers or companions of physically impaired customers are not required to pay an additional driver fee. A Young Driver can be an Additional Renter if the rented Vehicle Class is listed under the Age of Renters Section 11. All applicable fees still apply. No other persons are authorized to drive the vehicle. Rental requirements vary by location. Please refer to the terms and conditions for the NextCar location where you intend to rent a vehicle for specific information on additional renters, drivers, and fees.

  11. Age of Renters:

    The minimum age to rent a vehicle at most NextCar locations is 21, except when renting under the Insurance Replacement (IR) Rental Program. Renters, additional renters, and/or authorized additional drivers who are 21 to 24 years of age will be charged an underage driver fee in addition to any additional driver fee, if applicable. Renters 21 to 24 years of age are permitted to rent only Economy through Full-Size Vehicles, Compact and Intermediate SUVs, Mini Vans, Work Pick-up Trucks, Cargo Vans, and Cargo Trucks.

    Please refer to the terms and conditions for specific information on driver ages at the NextCar location where you intend to rent and for the applicable charge for drivers ages 21 to 24. The underage driver fee may apply to drivers renting under the IR program who are 24 or younger.

  12. Gasoline and Refueling Charges:

    The renter must refill the fuel tank within a 10-mile radius of the rental return facility. The fuel tank must be at the same level as when the vehicle was rented, and a fuel receipt must be presented to avoid a refueling charge.

    Renters who choose the prepaid fuel option, if available, will pay the specified charge as outlined in the rental agreement and have no obligation to refuel the vehicle. No credit or refund will be issued for any fuel in the tank at the end of the rental.

    Renters who do not choose the prepaid fuel option, do not return the vehicle with the same fuel level as when rented, and do not provide a refueling receipt within 10 miles of the return location will be required to pay a refueling convenience fee and a fuel charge for the cost and service of refueling the vehicle. The fuel charge is based on the estimated number of gallons needed to refill the tank, multiplied by the per-gallon rate specified in the rental contract.

  13. Rental Rates and Geographic Driving Limits:
    1. Rental Rates:

      Most rental rates are based on a 24-hour “rental day” that starts at the time of rental. The minimum charge is one day, plus mileage if applicable. The renter will be charged for each hour and/or any part of an hour in excess of a “rental day” the renter keeps the vehicle, until the vehicle is returned, up to the applicable daily rate. Mileage charges, if applicable, will be based on the number of miles driven, as determined by the odometer readings at the beginning and end of the rental. If the renter fails to comply with the minimum or maximum keep conditions applicable to the rental rate (including any geographic driving restrictions), a mileage charge, rate surcharge, or another rate plan may be charged. Calendar day pricing will be disclosed when in effect.

    2. Geographic Driving Limits:

      The Vehicle shall not be used outside the continental United States without prior written permission from the NextCar location where you intend to rent the Vehicle. Please refer to the local terms and conditions for any additional information on geographic limitations at that location.

  14. Optional Equipment and Services:
    1. Child Safety Seats:

      For an additional charge that varies by NextCar location, infant, toddler, and child/youth safety seats are available at some locations. Please contact NextCar at (443) 909-7000 to confirm availability and reserve a child safety seat. Some states may restrict rental personnel from installing the child safety seats on your behalf.

    2. Ski Racks:

      Ski racks are available at some NextCar locations where travel to ski resorts is anticipated during the winter season. There is an additional charge for ski racks. Please contact NextCar at (443) 909-7000 to confirm availability.

    3. Navigation System:

      Many NextCar locations offer navigation devices for use during the rental for an additional daily charge. The small, dashboard-mounted device is programmed for multiple languages. It contains mapping details for the entire U.S., with nearly six (6) million points of interest, including hotels, restaurants, gas stations, ATMs, and tourist attractions. Please contact NextCar at (443) 909-7000 to confirm availability.

    4. One-Way Rentals:

      Availability of one-way rentals within the continental United States varies by NextCar location and vehicle. Typically, a one-way drop fee and a one-way rate plan or mileage charge apply. Please refer to the locations’ terms and conditions for additional information on the cost and availability of one-way rentals at the NextCar location where you intend to rent a vehicle.

  15. Additional Fees and Charges:

    At many NextCar locations, the renter may incur one or more of the following charges and fees: an on-airport or off-airport concession recovery or access fee, an airport consolidated facility charge, an airport transportation facility charge, frequent flyer surcharges, and vehicle license fees. There may also be other government-imposed fees and charges included in the total rental charges. These charges may be calculated either as a percentage, a per-day charge, or a per-rental charge.

  16. Renters with Physical Disabilities:

    If a renter will require driving aids to operate a vehicle, please get in touch with NextCar Customer Care at (443) 909-7000 at least 5 days before your rental. This will ensure equipment availability and allow NextCar personnel to install the equipment before arrival. If a traveling companion will serve as the driver during the rental, please advise the NextCar representative at the time of rental. There is no additional charge for an authorized additional driver accompanying a non-driving disabled renter.

  17. Lost and Found:

  18. Tolls

    At Maryland NextCar locations, tolls are the renter’s responsibility. We will bill you for the cost of any tolls incurred while renting our vehicle, plus an Admin fee of $2 per in-state toll and $5 per out-of-state toll.

    For other NextCar locations, please check individual location pages for specific terms and conditions.
